I leave work in approximately 3 weeks to care for my disabled son - should i wait until i am receiving benefits to declare bankruptcy - im already on low income but claim alot of disability benefits for son

if you go br now or later i cant see it making a difference, as change in income has to be delcared to OR anyway. So i would say you might aswell get the ball rolling!

See what everyone else says as i am not an expert

Hi and thanks for your reply Jen

I was just thinking that they may not declare BR at all with income and benefits, as when i work it out i seem to have more than 100 each week of disposable income. (however this is based on big tax credits allowance with having disabled child). Ive struggled to make the decision in leaving work as i have a wonderful part time job that gives me a sanity break from being a carer.

Hi

if the sum of your debts outweigh the sum of your assets you are technically insolvent whether you can afford the repayments or not.

With your plans as they are and repayments soon to become unaffordable you are able to begin the process as soon as you choose.
