Hi, can any one help please? my partner and I were made bankrupt 2nd Aug 2007 and are due for automatic discharge on 2nd Aug 2008, which is great! During the period no payment orders have been made as neither of us have worked, As we are supported by our families after closing the business. The question I have is, after the automatic discharge can payment orders be applied? and are we free to just get on and earn what ever we want? because I have been offered a good job with very good pay, and want to except but obviously don't want to have to pay..... I said I can start on the 4th Aug 2008 but just want to double check.. Many thanks and I look forward to hearing from you.

Income Payment Orders can only be instigated whilst you are bankrupt - so once you are discharged they are not relevant.

Thank you so much for getting back. So, to be clear! I can start a job on the 4th Aug 2008 which is the first Monday after my discharge, and I will be free to earn as much as I like without fear of being contacted to make arrangements to pay from my surplus income? As my first pay day would be the end of Aug 2008 "sorry to confirm just need to double check!"

two more questions, if thats okay?:

What would happen if I started the job say on July 1st 2008, one month before my discharge? as i would not receive any wages until the 1st Aug 2008, one day before my discharge!... Would it be to late in the game for orders or arrangements to be enforced regarding my surplus income? - I am not being dis honest I am just busting to get back to normality and having cash again, as my partner and I have been living out the country for the last 8 months and returning in May, expecting our first baby in september.....

At the point of dischage do I have to fill out any paper work? or does it all just happen automatically?

Hi wpt,

Yes once discharged you can start your job without the consideration of having to pay into an IPA/IPO.

If you started your job prior to discharge under your restrictions of Bankruptcy you should inform your trustee of this change in your circumstances, Although I do think this is late in the day it would not stop the trustee issuing you with an IPO/IPA at this point.

At the point of discharge this will happen automatically, if you would like a certificate of discharge then you will need to contact the court in which your Bankruptcy order was made and request your certificate of discharge, however there is a fee for this of £60.
