My partner was made bankrupt in Aug 2007 and then discharged in Aug 2008. She then received a letter from the council (who originally made her bankrupt) saying that the banding on her council tax had been changed (on 30th Sept 2008) and she was going to receive a rebate cheque for £1800.00, since this letter come through in March 2009 the receivers had claimed the money saying that this money related to period before her bankruptcy. My question is do they have a claim for this rebate as it was re-banded after she was discharged?

I think the OR has powers to claim any money/windfalls for the period of during/before BR. Does the rebate say what period it is for? The OR would be able to claim the rebate for any period up to Aug 2008. Anything after that should be yours to keep.
