More questions!!!! We've finally sorted a rental out and get the keys on friday, so now saving for court fees. I have a few further questions. 1. My husband has started receiving calls at work from LLoyds TSB, i'd be grateful to know how anybody else has dealt with this and can we prevent them from doing this? 2. How does BR effect insurance policies? I rang today to change our home insurance from contents/building to just contents and I noticed one of the questions was have you ever been declared BR. 3. I spoke to council re Council Tax yesterday and they've said we're still responsible for our mortgaged property until we receive a letter from northern rock advising they've accepted the property back from us. I presume when we send the key back on monday that they'll write to us to say received, is this sufficient? I'm sure there were other things I needed to ak but my mind's gone blank now, all starting to get a bit much with the constant barrage of calls. Gonna be a long few months until we have the money together for court!! |

Hi,
If it's possible then go into the Lloyds TSB site and change the phone numbers in there if possible He could always try saying that he doesn't work there anymore!
You can truthfully answer the insurance at the moment as you have not been declared BR.
Any shortfall from your house should go into the BR, I believe that will include the council tax as well.
Hopefully an expert will be along to clarify.

Thanks, I didn't realise we could include the council tax for mortgaged property in the BR. I just assumed we'd have to find the money to pay for both properties. |

I'm sure someone will correct me if I'm wrong, but any council tax arrears up to the date of BR can be included, but I'm sure that after that they can't be.

Hi Panickedmum, your questions mirrored the ones I had at the time of BR so I hope I can help from my own experience. 1. I got calls from TSB at work which caused few problems. I wrote to Lloyds/TSB stating that I was receiving financial advice and to remove my number from the database or like Kallis said if you have on-line banking with them change the number. I found they stopped ringing then. 2. Like Kallis said you are not BR today so you are answering truthfully by saying no. I did the same as two weeks before BR arranged contents only on my rental property. After BR, however, I checked the contract and it did say "they may retract the policy if you become subject to BR" ... I rang them in the end and they said it was ok as long as payments were made? 3. Have you been paying your council tax? I paid my 08/09 over ten months but moved out of my mortgaged property on 22nd March. I rang them and told them I had moved and left the house vacant. They said the same that I would need confirmation. I had few problems getting NR to accept the keys and to possess the house but the council were good in that they put note on my file to say the house was vacant and that I am now with a different authority but they would need confirmation of possession as soon as possible. I recently had a letter from my ex-council authority asking for confirmation or I owed them money from 1st April to current date. I sent them my re-possession letter that was sent by NR eventually in May and copy of my tenancy agreement dated March 22nd and confirmed that I am now paying money to a different authority. Lo and behold I have just received a cheque for £21 which was a refund of tax paid between 22nd and 31st March, so was really chuffed. If you are up-to-date on payments and you are vacating your property you wont need to include it, as far as I know but you will need to contact the council to tell them you are vacating and that it is empty. I know tax is paid over 10 months for the whole year so you may find you are up-to-date or may owe just pounds and pence? But if you have stopped paying or are in arrears, then like Kallis said you can include it on the SOA. I used to be with Birmingham and found them most hopeful when I contacted them. I told them the truth about my situation. Others will correct me if the advice I have given is wrong but given you a rather long-winded account of my situation??!! Good luck. ps to you and all interested parties. NR put my house up for sale about 3 weeks ago and it is already sold subject to contract! so at least I am not waiting for ever to see what the shortfall actually is/was. I did include it in my SOA though so all should be fine. Rosie

Sorry guys, just to add to my epic entry earlier. Panickedmum, you may find if you are not filing for BR for some time then they will remove the telephone numbers but they told me they could re-instate after a couple of weeks? I still find even though I went BR 7th April that I have the occasional text from Lloyds so they have honoured my request to only contact one "given" number -asking me to contact them but I am ignoring them now as I just think they are taking a while to update their records once the OR has informed them. Bizarrely I also got letter from Northern Rock telling me I was now "Seriously overdue paying" etc etc.??? Most bizarre as they have my keys, they have sent me a letter saying re-possessed as of early May, and the OR must have contacted them by now. I have just ignored it. You will find a new-found confidence in either talking to them or ignoring them once you are BR because you can give them you Court number and just say "All being dealt with by the OR" etc. It will get better honestly.

Thanks again everyone.
We missed the first 2 months CT payments at old address and then when I contacted them to say we were moving I paid £50 towards as gesture of goodwill and they are to send me a final bill for that address once we've provided proof from NR that they have taken possession of the property. We can't afford to pay towards both properties so are concentrating on the new address and will just have to include the previous property in BR if that's allowed then. |

Hi Panickedmum, Just on the home insurance, i've had a post on this for the last few days. It's not always a problem, i just got the okay for a new policy this morning.
It's a clause that some company's use as as a BR you are seen as high risk for fraud, i.e making fraudulent claims. When the time comes just explain your situation and they should be fine. I told them that i had never made a claim on my home insurance and i think that helped.
I've been BR since Sept 08 and once you get through the first 6 weeks or so you relax and until the other day i hadn't even thought about my BR. When i think back to what it was like 12 months ago it now feels like a lifetime ago. It will get bet better, I promise!! |
