I've been living as an expat in China & Thailand since 2006. I have debts of aprox £18,000. I was made redundant April 2009 & have no income whats so ever from UK. I have no property in UK. I have some savings in a UK bank. Please advise if I declare myself bankrupt it will be a way to aviod paying off my debts. I have been in contact with the loan companies but they've not offered much help. I have a family in Thaialnd which I shall support until my saving srun out. After that I don't know what will happen. Please help.
If you declare bankruptcy in the UK then your debts will be covered by the bankruptcy. However you have to be present in the UK on the day your petition is presented to Court, or been resident in the UK at any time in the 3 years ending on that day. It is possible to provide someone in the UK with a power of attorney, that would enable them to petition on your behalf, but that will incur additional costs.
My son has been living in Thailand for a few years Intially he stillused my address but has stopped thishe has about £20000debts I think and I am worried that he will not come back due to this I would like to solve the problem. Could he decalre BR whilst physically here on holiday and /or re register at my address. Any suggestions
