I will be pettitioning for my own BH on Friday 3rd of July. I am defaulting on an IVA due to retiring at age 60 with health issues. As I had an IVA i do not have a normal bank account. I have a Nat West step account, it is only a cash account. My state pension of £130 is paid into this account every Monday. I leave enough in to pay my utility bills by direct debit. these are taken out monthly. My state pension of £130 per week is my only income. Is there a way I can avoid this account being frozen? There is no other money in this account. It empties every month as my bills get paid. Should I try and have my state pension paid into someone elses account. I asked the court about this today, they said I needed to get some advice as they could not help. It may be too late to do anything by next friday. Would be greatfull for any advice.

Hi bennieblueeyes

You need to let the Official Receiver know when you speak to them initially that you don't want the account frozen. They can contact the bank to let them know that if your only income is benefits into the account, they have no interest.

Thank you for your reply. I am most greatful for this site. It has helped me a great deal. It has been my only support as I live on my own. It has also saved me from being physically ill through worry. Every one that has made a comment on my behalf I would like to thank you very much.

Thank you Jan, for sending your luck. I am feeling up tight as I have been threatened with bailiffs. They are about to go to court to send bailiffs in. So friday cannot come quick enough. I am feeling up tight and feel my life is on hold til friday. I think it will be the longest week of my life. Regards Carol

I doubt they can get an order to send the bailiffs in before Friday.

Read this link so you know what bailiffs can and can't do if any come knocking on your door.
