Where to begin...After 3 years of fighting, 2 redundancys and the recession I am booked in at the county court for a bankrupcy hearing in 2 weeks. I have recieved the forms and have the folllowing questions 1/ I am currently covering maternity role at work which ends on the 6th July. I am in the process of applying for a job in the same department but will not know until the end of July. What do I put in the form? 2/ Both my husband and myself are going bankrupt what can I put down for essential living costs I have 2 children aged 3 and 5? 3/ We have recently used £800 of catalogue credit to get a variety of things including presents for my 3 yr olds birthday. Will this be questioned? 4/ Do I set up another basic account know or wait till after the bankrupcy? 5/ I have a car that I use for work and taking the children to school, it is worth about 1k will they take it?
I have so many more questions but this is a start...Can anyone help??? |

1. Put the job that you are doing on the day that you declare BR on the form. If you declare before the 6th July then put the maternity role down. If it is after the 6th then don't put any employment down.
2. Put down the costs that you pay or that you contribute to the bills/food, etc. i.e. if the electricity bill is £50 per month and your wage contributes £30 to this then put this amount down. You will go through the I&E with the OR during the interview so you can change any figures required then.
3. Yes, if you have used credit within the last couple of months the OR will want to know the details. If it looks like you used this credit without intending to pay it off then you may get a BRU but this will be at the discretion of the OR and will depend how much you spent, when you spent it, what you bought, whether you paid any of this off as part of the monthly payment, etc.
4. If you already have a basic account then you should check with the bank if you can keep this open. If you can't, or don't have a basic account, then open one before BR but don't put it on the SOA. Mention it to the OR during the interview and there won't be any problems.
5. If you need the car for work and taking the kids to school then it should be ok. It is up to the OR whether you can keep the car but from what you say it sounds like it shouldn't be a problem keeping the car. |

Thanks you so much for your quick response, can I just ask if I am un-employed then I will not be contributing anything so should I put nothing down. All biills will be coming out of my husbands salary? Or should I put what I would normally contribute and then hopefully if I am re-employed they already have figures in place?
Does this make sense???? |

If you are unemployed then put down your income as zero and the same for your outgoings. Don't put down your income/outgoings in anticipation of getting another job as this may not happen although hopefully it will.
When you get another job you have 21 days to inform the OR of any changes to your income so let the OR know. Once you receive your first pay statement you can let the OR know exactly how much income you have and can put in some outgoings as well i.e. contributing to bills, costs of travelling to work, etc. |

Hi, will they then take my car though? I am concerned that as the car is required for me to get to work and use for the children?
It is only worth 1k?

Ellendr Im sure I have read if its worth less that £2000 and you need it for work and such then you can keep it.

Try not to worry Ellen. I was the same as you, worrying about something new everyday. You always think that your going to be the one that has a really hard time from the OR when in reality (from what i have read on here) and in my experience it is no where near as bad as you imagine it will be.

It will give you an idea of what you can put down for essential living costs.
There was stuff on there that I never thought I would be able to put down as essential such as a domestic break but all were accepted.
When you come up with what you think you need to live on post it on here and people will tell you if they think it looks ok.
