i want to apply for bankcruptcy but don't know where to start. i was in an iva which is going to fail 3 months from now. can someone please help me of where i need to go from here. i've spoken to my iva supervisor and they have said bankruptcy is best option for me as i own nothing. so next step is this. how ever i don't know where to start and its driving me mad! any help much appreciated |

Hi there and welcome to the forum
You need to check with your IVA Supervisor whether there is provision for them to make you bankrupt within the IVA proposal, and if so whether they have funds available to do this. Assuming that neither issue is relevant, you can make an application to Court directly at a cost of £495.
The application forms are easily found on the Insolvency Service website - www.insolvency.gov.uk, and are relatively simple to complete - with information very similar to that which was contained on your IVA proposal, so if you have a copy of that you are halfway there.
Is there any reason why your IVA has failed?

i started my iva last year, it was going well but now my circumstances have changed, so from paying £685 i can now only pay £180, i spoke to my supervisor yesterday and she said my creditors will not accpet this. she advised bankruptcy will be the best option. She said once i have defaulted for 3 months thats when my iva fails. How do i find out which court i need to go to?? |

Unless you have moved, it will be the same Court that your IVA is governed by. Where do you live?

You need to check your IVA paperwork, as like Melanie says unless you have moved you will go to the same court that your IVA was at. If you have moved or need to contact the court for any reason you can find the details on HMCS website - http://www.hmcourts-service.gov.uk/HMCSCourtFinder/.

Thanks for that, its in the strand! i live in enfield. skippy i read ur blogs, i hope mine is as smooth as urs! i want to get it sorted asap as i don't want creditors to start calling me again! i will probably be on this site quite often coz i'll need help filling in my forms!

just checked my paperwork and it is the royal court of justice. which is in strand. i'll call them tom and request a bankruptcy pack and find out if i need to make an appt. |

Hi - I have just gone to court for BR after a failed IVA. I too defaulted on the payments after being unable to meet the level set. I eventually petitioned for my own BR on the 18th of this month and it is such a relief to know that after years of debt worry it is finally coming to an end. I have my OR interview on the 9th - by phone - so it feels like it is all coming together. Hope everything goes smoothly for you - nice to know there is someone else who can understand where I'm coming from!

If you are applying to the High Court, you cannot make an appointment but need to turn up in the morning and join the queue - which seems to be getting ever longer these days!
