I was made bankrupt about three weeks ago, naturally I wanted to keep my business private so the only people I told were my wife and my mother who I have great faith in, in that they would never betray my trust.
The bankruptcy hasn't been in the local paper yet so I was a tad annoyed when my mother-in-law told me that my wife's nephew asked her how I was getting along with my bankruptcy. Obviously it was news to her and she asked him where he'd found out about it (after confirming it was true with my wife). He wouldn't tell her but when I questioned him he admitted he'd overheard it at home.
His mother (my sister-in-law) is good friends with a woman who works in the office of my employer and the only way I can conceive she found out was through that person.
Does the OR tell your employer of your bankruptcy, I know they can get to find out or deduce this when your tax code changes?
Anyway, I realise that eventually what has happened will all come out, it's just the way I found out was annoying as my manager and MD at work haven't mentioned anything to me and I find it most disheartening that a work colleague would gossip to a relative of mine about something that frankly is none of their business.
If this is the case and my employer has been contacted by the OR is there a case of breach of confidentiality on behalf of my employers office or am I just being a bit paranoid? |

As far as I am aware, the OR doesn't tell your employer other than the payroll department to alter your tax code.
If someone has mentioned this to another person, and it has spread, then I would make a complaint as whatever happens at work should stay there and not be spread around your relatives.

Thanks for that Jan, that's what I thought. The problem is I work for quite a small company and the person I suspect of gossip (for which she's well known) is the person who would open all mail addressed to the company. I'm not sure if the OR has been in touch with reference to my tax code, I haven't got the interview with them for another two weeks. |

I'm not sure when the nil tax code gets sent out, although I would have thought it would be after the OR interview, although not too sure about that.
It is a mystery how she has got to know. I think I would be tempted to ask.

It's not actually the OR who deals with the NT code, it's HMRC. They will send a new notice of coding to your employer, the same as they would for a normal change.

No, they shouldn't do - the only reason I can think they would is if the employer is a creditor.

Your bankruptcy would be listed on the Insolvency Register which is a public access document, some people have nothing better to do in their lives than read this to see 'if they know anyone' The OR would have not notified the HMRC yet, not would the HMRC have been in touch with your employer with your NT coding in such a short period of time - perhaps the gossip read the notice in your paper ( you may have missed it!) bankruptcy orders are usually printed within a week of the order being made.
Unless your employer was a creditor there is no way your OR would have notified or contacted your employer, it is not something they are required to do.

Very annoyingly if you 'google' my name the very first hit that comes up is for the London Gazette with the notice of my Bankruptcy.
No hiding for me and as I am currently job hunting and getting no where with it - I wonder how many employers google peoples names when deciding whether they want to interview them or not. Grrrrrrrr

I doubt that many would - it depends on what sort of job it is and whether or not people know about the register.
Google my name and I am a real estate agent, an artist - nothing comes up for me being insolvent at all.

| Hi just thought that i would mention that the bankruptcy is no longer published as a matter of course in the local paper although it is still in the london gazette. It may still be published in the local paper in certain unusual circumstances. |

I am aware of the legislation, but I have also been told that the majority of BR's will still be put into the paper. It is down to the individual OR.
