Hi

We had our IVA approved in August 2007. Prior to this we had made six payments which we were told would cover the 1st six months. After the 6 months we have heard nothing form the IVA company despite us sending letters and making phone calls. We haven't paid anything as we don't know how much and who to. The company are called Synergi. We have now complained to the financial ombudsman and they wrote on out behalf, again no reponse from Synergie. When I phoned the number on the government insolvency site they said there was no record of our IVA. We have now got debtors phoning us up and a bankruptcy order being made against us. My husband has an interview with the Official Receivers about the bankruptcy in a couple of weeks time. We just don't know what to do next. We are willing to pay our debts but because of this companies incompetence we don't know what to do. Will the official receiver understand? The fact that we have complained to the ombudsman will surely go in our favour? We really don't want to end up losing our house over this as we have always kept up with our mortgage. Part of me just wants to go ahead and go bankrupt and the whole nightmare will be over but does that mean we will lose our house?Any advice gratefully received.Been on the IVA forum sister site to here and they said to get an insolvency practitioner but I wouldn't know who to trust after our experiences with Synergi. Really confused. Sorry to rant on!

Im so sorry to hear whats happened to you, It must be horrible after all you are trying to pay your debts.

Dont threat, we are here to help.

First of all goto:

http://www.insolvency.gov.uk/eiir/

This is the insolvency register search utility and see if your name appears, select all courts.

Secondly goto:

http://www.insolvency.gov.uk/cib/index.htm

This is the insolvency service complaints department details, here is the link for the form you need to complete:

http://www.insolvency.gov.uk/complaintformcib.htm

Thirdly goto:

http://www.insolvency-service.co.uk/newipsearch.htm

This will allow you to find the Insolvency Practitioner (s) who deal with that company this will provide a phone and maybe Email details

Your best to goto a small IP Firm such as Thinkmoney or an independent IP Such as Melanie Giles or David Mond

Hi

thank you so much Stu that was really useful. There is no record of our IVA at all which is really worrying as we have paid over 3 thousand to them in the initial 6 payments. I have made a complaint as you instructed and then serched for the IP who dealt with us from Synergi, the search came back with nothing. I feel that we are doing something about it now though and will await what it says about our complaint. Thanks again. I wish we'd found this forum sooner then maybe we wouldn't be in this mess! Will contact an IP tomorrow.

Hi

So glad I can help, ive just had a look on the insolvency website and their are two IPs to contact, they are:

elaine.masters@synergipartners.co.uk and

sue.watts@synergipartners.co.uk

Have you got proof that you have paid them, could you get electronic copies to Email with your complaint.

Also have a look on iva.com they review different IVA Companies of which Synergi is on and they get a mixed bag of reviews.

Did you have a phone call telling you your IVA had been approved? You should also have had a copy of the Chairmans report within a few days. Do you still have your proposal?

The more paperwork you have, the better.

Please make sure that when you ring the insolvency practitioner tomorrow that you discuss all your options including IVA, Bankruptcy, Debt Relief Order, full and final, formal arrangement and Debt Management Plans, therefore, moving forward, you will be following the best option that suites you.

You may find that the person you dealt with at Synergi was just a case worker and not the IP.

I take it you have made no more payments since the initial ones?

But its the IPs profession thats on the line, and if you complain to them with evidence they should/would have to act

Before anything is progressed, then twinkletoes needs to establish exactly what has or hasn't happened with the IVA.

I would suggest that she might like to post on the sister forum www.iva.co.uk as there are professionals on there who can advise further and I do know that there was a member of Synergi who posted on there.
