Hi again!
Ok the time has come to sit down and start my paper work for BR. Just a couple of questions i dont fully understand tho....
1, Do i need to fill all 3 copies of my BR forms in?
2, Question 3.9 do you have the use of another motor vehicle that is not my own? (do i have to put down my moms disability car? i am a named driver but i never drive it)
3, WHERE in question 7.1 Do you put your TV licence details, monies for my daughters travel school and collage etc? And also are you allowed to put down pocket money for the children?
4, I also have no idea what to put down for car repairs, tax and household items that i will have to save for just incase one breaks down. I have never budgeted before, i always had a C/C
5, What is a reosanable amount to say for a family of 4 children and one adult, when it asks about clothes? i usually just buy what i see when i am out, and they are usually in sales.
Any advise would be good, because i dont want to mess my paperwork up.

Hi there - hope this helps.
1 I would fill in one and photocopy it twice.
2 If you don't use the car then there is no need to declare it.
3 Put down everything you spend - have as many categories as you like and go onto a separate piece of paper if necessary.
4 Try and work out what you have spent over the last year - your credit card statements can probably help here, and then divide that expenditure by twelve to get a monthly average.
5 The CCCS guidelines allow a maximum of £76 - but again put down what you feel you need to spend.

Could you also advise me about the allowance for food as before for 4 children and 1 adult, sometimes my shopping is a little extra if i am buying washing powder and cleaning products which does put my spending up by approx £20. Would £110 be too much for a weekly shop?
And do i need to give details of my last job? it has been 13 years since i was last employed.
And one of the questions, In the last 2 years have you made any payments to a creditor, other than in the ordinary course of business, with a view to improving the position of that creditor in case you became subject to insolvency/bankruptcy proceedings? Could you advise me what it means please.
Sorry for being a pest but i want to make sure i have the correct answers.. |

Under CCCS guidelines, the maximum allowance is £484 per month, or £111 per week to be precise.
If you have not worked for 13 years, there should be no need to disclose your previous employers.
The last query is asking you whether you have paid anybody with a view to preferring them over the other creditors. For instance if you owed your sister £5,000, and won £10,000 on the lottery. Did you pay her back in full, and only give half to the other creditors. That would be an unfair preference, and the Trustee could ask her to pay some of the money back, to ensure an even distribution.

I see from your last answer that the OR could recall a full payment if one has been made to pay off a debt. Have I understood that right? |

Yes you have understood Melanie's post correctly, if you have given preferential treatment to one creditor over the others by paying a debt in full prior to Bankruptcy proceedings then the OR could claim this money back.

Thanks that is intersting to know. I paid off outstanding rent arrears to the local council before xmas to the cost of 2k which was outstanding from 05. Would the OR be likely to recall this?? |

They have the ability to recall this, but I doubt very much they will, due to the fact it was rent arrears for your property.
