firstly thanks for previous help, have a couple of questions, how long do i have t provide bank statements and credit card bills a year or more also have got appointment at the court for 18th aug do i have to get paperwork signed by a solicitor before that and is that actually my bankruptcy hearing?? also do i have to include store cards statements which i have no debt on and are fully paid off??? many thanks again

You normally need to provide 12 months of statements and this is for all accounts even the cards that are paid off. Don't worry if you don't have the statements the OR can easily get them from the creditors.

You don't need a solicitor to declare BR. You need to turn up at the court for your appointment with 3 copies of the SOA (unsigned) and the £510 BR fee. If you are declaring BR in the High Court, London then it is only 1 copy of the SOA and £522 for the BR fee. The clerk will check through the forms and make any changes if required and then you sign the SOA in front of the clerk. They will sign one copy and hand it back to you.

A few courts have two appointments; the first is to hand in the SOA and pay the fee and then you come back a few days later, which is when you are declared BR. With most courts it is all done and dusted on the same day. Which court are you petitioning at?

thank you again for your help.I am petitioning at Bristol,why do you need 3 copies of soa they have only provided one?? do i just get it photocopied???

Yes, you will need to get the SOA photocopied. One copy is yours once you and the clerk have signed it and I am not sure but one copy would be for the BR clerk and probably one for the judge.

Hi, i am going to Bristol county court on the 17th August. When i phoned to make the appointment, they told me to bring one copy of the SOA, three months bank statements, three months wage slips, and the fee. Im not getting a solicitor, and they never told me to bring in any credit card bills. Also if you're on benefits like working tax credit, you need the award notice or proof of benefits for claiming a fee remission on court costs. hi nicdavies, so how come you got so much information and i got nothing??? apart from date time and fee!!!Are any of your debts on credit cards??? mine are, also i am unlikely to have my award cert for wftc as haven't put my claim in yet as i had my own business that i have had to give up due to illness and losing customers unable to replace despite advertising again. have visit from welfare to check i am getting everything i should be next tue but am hoping they will deal with wftc for me too. where did you get any advice about this from???

I am going to phone the court again sometime soon, because i was due to go bankrupt on the 6th July. Got there, and because my bank hadn't sent a statement on time, they had to make another appointment for me. So now i've got to see if i can get another form from them as things have to be amended. Also i signed it before going there, and people have said it has to be signed at the court.
As for the tax credits, i think you can apply at the revenues and customs website. yes - i've put revenues and customs in search. Good luck for the 18th!

Hi

If you are claiming a fee remission then you will need to prove that you are either on the allowed exemption list due to the benefits received or alternatively able to claim due to reduced income.

This is why one needs to bring 3 months payslips and bank statements to the court for proof of the above.

Regarding the court in Bristol you can re sign when you are at the window and simply cross out the first signature.

The team in Bristol are fine provided that you have fully filled in the form. Because they are always busy they don;t really have time to go through the form and help you fill it in during the appointment.

Hi paul, was self employed so have no payslips but have accounts,do i have to take credit card statements with me as well?? is it definately only 3 months i need?? this is all so confusing and i canot get help from any of the normal sources that are available as they are all inundated with other people, should i open another account to move my family allowance and wftc to as they are due to be paid in the day of my hearing? the more i read the more confused i get Help!!!!

Hi Morwenna

At Bristol you only need one copy of the Statement of Affairs, and one copy of the petition ( 2 page document). They will photocopy and give you back a copy.

If you are applying for a remission in fees, and have been self employed I suggest you pop into the court ( Greyfriars ) before August 18th to get that bit sorted first. They will need to see some documentatory evidence to help with the claim.

You will not need to take credit card statements etc to court. The Official Receiver will request these later.

why not either give the court a call to ask them their procedure or if you can't get through I will be happy to go through it with you. We are generally in court in Bristol once a week so quite familiar with the process there.

thank you paul that has cleared up some things, do i need to make an appointment to see them at the court to sort out fees??? did try to phone yesterday but was asked for a pin code which i haven't got and then it cut me off! less than helpful, how would i go about seeing you for help?? and does it cost much as i have had to give up my business due to ill health so i am not working at the moment so things are even tighter than they were before i had only carried on for the last 18mths because of the debts dr been telling me to give up for same amount of time. thank you again for all your help

not sure what number you are calling to get a PIN message - the direct number for the bankruptcy department is 0117 910 6756

The will be able to help and advise regarding any claim for fee remission ( depending upon your income and benefits received ) they won't however be able to give you any advcie regarding bankruptcy.

to see me for help will cost a cup of coffee. Because we are so close and in the Bristol area often ( 3 times this week already ) i am sure we can have half an hour or so. ( Also partial to chocolate biscuits as not alowed any at home!!! )

Hi paul sorry it has taken me a while to get back in touch i have loads going on as you can imagine. when would we be able to meet up and during that meeting can you help me to go through the forms as i dont want to mess them up. did phone Bristol court on the number you gave me and got through they dont want to see me before the hearing and they have told me what to bring to the hearing. Why do i have to bring my husbands wage slips as this is nothing to do with him??? many thanks again for your help
