I am having to go Bankrupt because of gambling debts. Whar will the official reciever do? |

Dependent on your gambling debts, and the amount you have you may get a BRO/U if you are still gambling the judge can refuse to allow you to go Bankrupt.
Have you sought professional help regarding your gambling i.e your GP, other health professionals

Hi Thanks for the reply. I have only been gambling for the last year had 3 close family members die and am of work with depression never been in debt before. What will happen if the judge refuses my bankruptcy.

The judge won't refuse your BR unless you haven't sought professional advice or don't have the BR fee.
The OR may decide to issue a BRU because of the gambling and this will increase the time that the BR restrictions (can't be a director of a company, charity trust, etc.) but you will still be discharged after 12 months. You will know more after the OR's interview but it's nothing worth worrying about; the depression and family loss are things you should concentrate on resolving. |

Many of my debts were incurred through my gambling over a period of 2 years and I declared myself bankrupt in March 2009. I mentioned my gambling debts to the OR early on in my bankruptcy and she did mention that I may get a BRU. However, 5 months on and I still haven't heard anything more on that as yet. I am hoping I won't get one, but I have a few more months to go before I am completely out of the woods. I think they have 9 months to put a BRU into action, so I'm keeping my fingers crossed. I did mention in the SOA that I was going to seek help with this addiction although at the date of my bankruptcy I had not yet attended any counselling sessions. However, during the past 3 months, I have attended weekly sessions on a one-to-one basis with a counsellor. To be honest I don't think it has really changed my gambling addiction, although I don't tend to gamble much these days (partly due to the fact that I don't have any money to do so) but maybe its helped me to avoid getting a BRU somehow. I don't know. I do know that I have been barred from one of the casino chains, but this was not implemented by me, so I can only assume the OR's office contacted them and they decided I was no longer a viable customer and have barred me nationally from their casinos.
If you are completely decided on the bankruptcy route, then I would start the process sooner rather than later. I hesitated for months due to worrying about what they would think (and do) with regards my gambling debts, but in the end, I did the right thing for me.

Hi
I would ask for the GP to provide a letter regarding your depression, have you had professional advice regarding your spending habbits, have you seen a psychiatrist. I have depression and I "comfort spend" which led to the debts, I detailed all of that on my SoA and provided a letter from my GP I didnt get a BRU/O and have had early discharge after 6 months
Best of Luck, try and provide alot of evidence that you have overcome your addiction and about your depression and how they are linked to one another and you may not get a BRU/O and may even be considered for ED

Hi,
I went BR owing 57K for gambling. I had never gambled before and had a mad year and a half. The judge was non judgmental, I was in there for a minute and he granted me the order.
I had two interviews (face to face) which were actually OK (they just wanted the facts, it wasnt like a police interview). I got a 4 year BRO....but can live with it.
Still worried about my wifes house, but certainly life before BR was horrible, and now lifes much better.

One last thing - you do NOT have to accept the OR's first decision - a friend of mine was going to be slapped with a 10 year BRO!! She appealed and had it reduced to three years.
I think you should probably expet the BRO and then negotiaite the shortest term possible with the OR |
