hi me and my husband took the first steps the other day and went and got the forms to fill in . but i am totally confussed as we ha ve always put all our money in one account and just paid for stuff we need as a joint thing .but i have to fill out a form for me and he has to fill out a form for him but how do we sperate our debts as i have loads of card debts and only earn a small wage but me husband only has 3 debts but earn much more then me but when u put our wages together they do not meet our needs or our debts .
im worryed that the court will look at my husbands and say he has enough money to cover the cost of his debt so he doesnt need to go br but if this happened we would not have enough to live on as he is the main earner but has the less debt any advice would be great as im totally confussed ??
Is there any reason that your husband wants to declare BR? If you declare then your debts will be written off and, from what you have said, your husband can afford to pay his debts.
Becoming BR isn't something that should be taken lightly so if your husband doesn't need to declare BR then he shouldn't.
The OR will look at your husband's outgoings that he is liable to pay (i.e. his debts) and not those that he chooses to pay (i.e. your debts). If he isn't insolvent then the BR will either be annulled or it will be refused in court. Either way you will have spent £510 on the BR fee that you won't get back.

sorry think u may miss understood my husband and i have a joint loan that was on our house that wasnt cleared up this is for around £81,000 so he will be lieable for this debt if i declare br he also has 2 other credit cards if he pays these normally then we do not have enough food money or petrol money i have loads of credit cards more then him i only rean £600 a month and just my rent is £700 so all the rest of stuff hets paid from his wages was just not sure how to fill out the forms .
i also have a ccj can this be put into my br? if so do i just list it as a creditor with the people i pay it to or should it go under something else on the form ?
