Hiya, I hope admin will allow me to do this......please 
This posting has been on your sister site IVA.co.uk but it really needs the expert advice from this site. It's quite complicated so I've posted the link so you can read through the whole post.
Please help/advise if you can as this lady is really going through it at the moment.

Hi Chris,
What A difficult situation for her, but I have seen this far to many times before.
The problem is this has all been left to the very last minute which always turns out to be costly.
She can file an N244 and try to suspend the eviction based on the re-mortgage and then go down the annulment road whereby she will need to negotiate and pay the Inland Revenue.
With the IR's costs going up to £12k I’m sure this can be negotiated and paid at a more reasonable level, Someone will then need to negotiate with her Trustee for settlement on their fee's which will be more difficult, but not impossible.
This is going to cost her considerable money for something that was a non existent debt in the first place and unfortunately the Trustee in Bankruptcy is working within the law, however disgusting this may be.
I would get her to speak to one of the Bankruptcy experts soon.

Thanks Julian, it just seems very unfair that this is happening. As the debt was non-existing could the whole thing not be dismissed? It's as though she is being made to pay for the Inland Revenue's mistake.

It is possible, but has really been left till the last minute, she would also still be liable for the trustee’s fees unless she could prove she was never made aware of the Bankruptcy hearing, but after reading her post on IVA.co.uk I think she was clearly aware.

(made bankrupt 3 years ago) I WASNT AWARE OF BEING BANKRUPT. didnt no wot a order was. realized they had the order nov o6. didnt no how serious my affairs were till then. when i start looking into the law n bankrupsy... i got really scared. legal advice n law people. . . seemed to make things worse... i couldnt tell my husband... we were having a few family problems any way. n think it would of ended wot we had left altogether... mark is really spot on with all our bills.every thing is paid well before they are due... we have no credit. except our morgage... always only ever bought n spent wot weve been able to afford... sharon... |
