Hi, I`ve just spoken to the court this morning and they have given me a date in 4 weeks to petition for Bankruptcy!! (which by reading some posts on here is quite quick!)
I havn`t burried my head in the sand and have phoned most of my creditors for advice and to let them know of my current situation.
My mortgage lender was excellent and has really helped me a lot, but I have one secured loan with Benificial finance and i rang them this morning, spoke to a really nice chap who was very helpfull but he said he had to pass me on to a different department. Well, I really wasn`t expecting the animosity from the female advisor!! i felt like i was trying to be dragged into some kind of argument, so the defenses went up and all I could really say was i`m sorry but i havn`t got a clue as to when i can pay you again!!
she explained that she will get payment directly from my wages, is this possible? I`m only at work for the next 6 weeks when i`ll be starting at university full time for 2 years, I`ll be recieving a small bursary, does anyone know if this will be affected by going Bankrupt?

Hi,

To take money from your wages would require a CCJ I think, with an attachment of earnings order which will take far longer than the four weeks until your hearing to sort out. I think it would be included in the BR anyway.

It was just a bullying tactic to try and get you to pay up. Ignore it - she's not worth losing sleep over.

Not sure about the bursary - hopefully one of the experts can answer that one.

Because it is a secured loan, it is not covered by bankruptcy as such, is it secured on a house? Are you keeping the house once bankrupt? If so, you should carry on paying the mortgage and secured loan payments, if not, ignore them and don't pay them

I do wish to keep the flat, and i do wish to continue to pay the secured loan, I rang them to discuss the options becaue i owe barclays £2,500 for an overdraft and my wages get paid into this account, I wasn`t sure that barclays would take the the money i owe them first to pay the overdraft, or would they hounor the loan payment to Benificial finance?
But alas the agent was to busy trying to get immidiate payment and, or, start world war three over the phone!!
I honestly dont understand thier tactics? surely a polite informal conversation over the phone would sort the problem out quickly as in the situation I had at Halifax, rather than get my defenses up straight away and make the situation worse as I really dont want to talk to them again!!

These secured loan companies can be very aggresive, I had the same trouble

If you want to keep the property, you MUST keep up the mortgage and secured loan payments.

If you are worried about the bank taking money to pay an overdraft first and not pay your secured loan, you really need to get your wage paid into a different bank account so that you have control over your money, you decide who gets paid first, not the creditors.

The overdraft/bank charges will be written off in your bankruptcy anyway, but you must make the mortgage and secured loan a priority payment and pay them even if it means not paying the other creditors, this is not seen as preferential payments as the loans are secured and if you don't pay them, you will lose your home

Thanx for the advice, i opened a co-op bank account last week, i`ll try and have my wages paid into this account.
I have missed one payment in 3 years, I just cant believe the hostility they give to someone who is just trying to sort the problem out and to get advice!! I want to phone them up again but I dont want to be dragged into another argument with them!!
