Hi, I was made bankrupt and was asked to signed a IPA even though at the time I was on income support. I have now been discharged and ever since I signed the IPA I have not made any payment to it as I don't have any money to put in. What I want to know is at the time I signed the agreement the Trustee said that I don't have to pay it if I don't have the moeny and therefore that was why I signed it to get him off my back. He is now demanding payment even though I am still on income support.What I need to know is can I set the IPA aside as this is causing me alot of stress. Regards to all

Hi Tom,

Income support is deemed by the government to be the minimum you can afford to live on therefore it is disgusting that they should suggest you have a disposable income.

If you do not pay into the IPA the trustee will have to apply to the court for an Income Payment Order this will give you a chance to argue your case in front of the judge who will make the final discussion If they agree with the fact there is no disposable income due to benefits then the IPO will be dismissed.

In this case I really do think your trustee is being unreasonable so in your case I would request that the trustee applies for an IPO.

I really don't think the Trustee has any chance of success if your only income is derived from Income Support. I suggest that you demand to speak to the Assistant Official Reciever dealing with your case for an explanation.

Thank you so much for all the advice. I am still confused as to why I was made to sign the agreement in the first place when he knew full well that I was on income support. Does it make the agreement null and void or it will run until the three years are up. I don't want this to hang over me as this is causing me lots of stress and is having an impact on my family.
