Our court hearing date is coming around so fast. My husband goes away very soon so I am having to do this on my own. Im really worried that we are going to lose the car. Has anyone ever disagreed with the OR about selling a car as an asset, and taking it to court?

Forgive me, what is the court date for? - I have looked back on some of your postings and see that you are already BR.
Is this something else? Come back with a little more detail and we can see what is happening.

I think the court date is to decide whether they are allowed to keep their car or not. The OR has decided that they do not need the car and wants to sell it as an asset but Shelley/Andrew do not agree with this so it is going before a judge to decide whether they get to keep the car or not.
Good luck with the court appointment and just make sure you have plenty of evidence (poor public transport, etc.) to back up your case for keeping the car. |

Thanks gettingoutofdebt - I only glanced at the postings - I know I had responded to some a few weeks ago.
It just occurs to me that one important factor may be health/disability.
Also vulnerability - I see that Andrew is away a lot of the time - if there are children and there is an emergency - than could you not argue the need for a vehicle.
I am clutching at straws as i do not know every detail of your domestic arrangements.
Whatever happens, as gettingoutofdebt has said, make sure you have evidence - do you have someone to attend with you?
I assume this is the county court and a District Judge - maybe on the day a duty lawyer may be available - they are most days.

Thanks for your replies and yes gettingoutofdebt is correct in what he has said.
The main reason we need our car is so that my boys from my first marriage are able to see their dad every other weekend. I moved from Sussex to Cornwall back in September 2005 and every other weekend on a friday have driven half the distance to meet the boys dad. They then go home with him and I come home. We then repeat this on a sunday so they are back home with me. We also do this in half term. This is our main reason for keeping the car although where we live is a small town and doesnt have alot of facilites so have to drive to next nearest towns Plymouth or Liskeard and with 4 kids on a bus/taxi is very expensive and somewhat dangerous when on my own (which is the majority of the time). I have gathered all the evidence that I feel necessary and pray that God is with me on the 30th Sept. I will let you know the outcome and thanks for replying gettingoutofdebt and Richard.

we are not far away it seems - I am in Plymouth - did you go to Plymouth CC and the Plymouth OR - again, I may have asked that before! I find the Plymouth OR office to be very good.
I am sure the rural element will assist and the fact there is very little by way of public transport and what there is is expensive.
