Hi Zoe,

If your particular trustee/OR is categorically not accepting this then what have they agreed to accept?

What is your valuation and current mortgage?

I have found little problem in negotiating property transactions, however with our assisted cases the preparation is in place prior to the Bankruptcy ready for the OR to agree and accept the offer made.

How far are you into your Bankruptcy?

If your OR is not playing ball it may be better for you to wait until they either refer your case to an independent trustee or the regional RTUL

No not accepting - property valued at 132000, redemption £116500 and £5000 Early redemption valid for another 3.5 years.
I will be discharged on 21 June

If it is yours have they accepted this figure?
Who valued the property surveyor or estate agent?

Hi Zoe,

before you do this I would not advice the use of an Estate Agent valuation.

Agents tend to value property more positively as if they were marketing the property for sale.

I would advice you to pay to have a Chartered surveyor to value the property.

Surveyors will value the property as if it were being done for mortgage purposes and therefore will give you a much more realistic market value.
Tell the surveyor that you want a valuation for the property to be sold within three months.

This should give you a lower valuation and as a surveyor has professional indemnity insurance to support the valuation this is acceptable within the OR's office.

Although your OR may not accept the redemption figure and sale costs, with a lower valuation you may be able to get around this problem.
