I have opened one of these accounts prior to going BR in late November. Is it true that you have take all the money out on the day of BR, or is it a myth? As I understood it the OR would not have an interest in this account. By the way I will only have enough in to cover DD`s and living expenses.

or can freeze account on day of Br, but can release neccesary funds however they may let you keep it if it is not linked to any debts and you explain that its a basic account not linked to Br.

If this account is new and completely unlinked to any of your debts you do not need to list it on the forms for filing for bankruptcy.(only list all accounts you owe money to or have which are linked to other debts) On the making of the bankrupty orde the OR will freeze all accounts held - When you have your appointment with the OR you can inform them that you have openend a new account for salary/DD's etc and provide the account details and thus you will ensure that your account will not get frozen - the OR will always arrange for such accounts to be unfrozen but this can take up to 5 working days - you can save yourself the stress by not listing on the forms - this is a perfectly acceptable way of dealing with the new bank account.

Hi Melanie, thanks for the quick reply. We do not go BR until late November, but we opened this account as soon as we had booked our BR court date. I have transferred all our incomes into this account and the Coop are presently transferring all our DD`s/ SO`s from Nationwide, so yes it is a new account and is not linked to any of our debts in any way. I will do whay you suggest, thank you,

John

To clarify, it's not the OR who freezes a bank account, it's the actual bank. Once they have been advised that the OR has no interest in the account the bank should unfreeze the account, although it's then down to them if they are happy for you to keep an account with them.

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.
