hi there

I was discharged from bankruptcy on the 17th November. Before i received a letter informing me of this i wrote to the OR informing him of a £21 pay increase. I have now received a letter form the OR informing me of my discharge and thanking me for letting them know of my pay increase however, they are not going to pursue it at this time, however to keep them informed of any other pay increase.

I do not pay an IPA, but my understanding was that once discharged they could not start an IPA. Do i need to let them know if i get any pay rise in future even though i am discharged?? and if so for how long??

looks like it has just crossed over between different staff. You are quie right that if no IPA has been set up it cannot be done afterwards an you no longer need to inform them of any changes

You do not need to inform the OR of any pay increases after you have been discharged from bankruptcy unless you have been sublect to an early discharge when you are still answerable to the OR until the first anniversary of your bankruptcy - the usual discharge date.

i had an early discharge! so whats the difference then from being discharged and still bankrupt if your still answerable to OR???

Can i still get an IPA then???

no the IPA cannot be started after discharge.You only need to inform the OR of changes up until discharge except if you have an IPA then you need to inform the OR until the end of the IPA

this is sooo confusing!! I thought once discharged the stress would go!!

Ok so I had an early discharge and had no IPA, therefore do not need to inform OR of anything??? I was hoping the letter the OR wrote may have been a mistake and possibly thought i had IPA, which i dont as it wouldnt be the first time they made a mistake!!

Right, I have this on good authority! If you read the technical manual correctly you would have an obligation to inform them of any changes up to the anniversary of the bankruptcy regardless of whether or not there has been an ED or not, but theory and practice are completely different...the last thing the OR wants is to update a file which has been closed on ED!!

This is the bit i read

e) he/she is also required to give notice to the official receiver, when acting as trustee, if any property is acquired by or devolves upon him/her, or of any increase in his/her income, during the period of his bankruptcy.

Notes: [s333(2)]

By definition the period of bankruptcy ends when you are discharged.

Once you are discharged, early or not, and have no IPA, then I don't think you need to inform the OR of anything, I sure didn't, I got ED and then got a job and moved house and I did not tell the OR,
