I went bankrupt in May'09,they asked me to pay £190 a month as I work, I told them I couldn't afford it but the OR told me to sign the form and then update them with any changes, I did after moving house and asked to pay £75 a month. I sent this letter in July and have had a response today (4 months later) saying they want me to pay £125 and that I now owe them money despite sending 3 further letters asking for a resonse to this. I am not able to pay this and am worried that it will make things even worse for me? Also I have no idea what I am entitled to include in my calculation of what I spend, for example dental work that I need and would take me a year or more to save up for if I was only allowed £20 a month towards this. I have mended my clothes so many times and they are not going to last as I have been in debt for so long I haven't bought new ones but am not allowed anything for this, I understand the debt is my own fault but I don't know what my rights are and have found that CAB and CCC are so over run they can't give you a full advice service.
ask them for a complete breakdown of the amounts that they have allowed so that you can see where you are spending a greater amount than the allowed part
Thanks for this, and I know this seems like an obvious solution but working for a local authority, administering legislative guidlines I know from experience that part of the law/rules are given but there are always exceptions and further information that can be given and isn't and I just don't know the best way to find this out impartially and fully
The reason i say this is that if you are going to challange something then you need to know what assumptions they have made. If you ask for a breakdown they cannot refuse, then post up here any things you dont think are right so we can have a look at them
