Hi, I am applying for bankruptcy on the 22/01/10. Please would anyone mind checking my I & E for me, it is for me and my daughter. Also please would you be able to tell me how much I will have to pay for an IPA as I will have about £145.00 left after all of my essential living costs.
INCOME £527.32 tax credits per month £86.00 child benefit per month £1108.00 Wages per month TOTAL INCOME £1721.32 per month
MONTHLY OUTGOINS
£465.00 rent £120.00 council tax £12.12 tv liscence £50 gas/electric £260 food/cleaning products/toiletries £72.00 travel £20.00 water £35 mobile phone £386 child care costs £60 clothes/ footwear/ school uniform for my daughter £15.00 hair cuts £40.00 school meals £40.00 lunch at work
TOTAL EXPENDITURE £1575.12 per month.

Is there just you and your daughter in the household? If so everything looks ok but what about:
Internet - Does your daughter need this for her school work? The Internet for educational purposes is an allowable expense
Dental/Medical - You should put something down for this just in case. Put £10 just in case you end up needing some dental work or need a prescription.
Clothes - I would probably raise this to £80. The guidelines are £43 for 1 adult and £117 for 1 adult/2 children so you should be somewhere in the middle and £60 is towards the low end.
Domestic break - This isn't always allowed especially if it is the difference between getting an IPA or not but it is worth a try. £30 for the two of you should be ok.
If you do end up with a DI of £145 then you would have to pay 50% (£72.50) as an IPA. |

check back through bank statements, you must be able to find something that they will allow worth £48 PCM. obviously something that you actually do,
I am sure that you have already looked at the OR web site for allowances (some one will post the link soon)
Car tax ?

Hi Jan Defiantly would not encourage anyone to put down false claim or avoid IPA however I would encourage anyone to check and check again, against the official list.
The OR will not say , You should have claimed for XYZ but they will disallow claims that do not match the strict criteria, My encouragement was for cpharo to go through bank statements and check the details
A claim has been entered for work travel, Does that include car tax, if not it could be added to the form.
I claimed for protective boots, a tool of my trade, which on first completion of the form I missed, the OR did allow my claim

They may not have a car.
I do agree that you should allow for dental charges for yourself, obviously your daughter's will be covered. Prescriptions will also be covered for your daughter, but you may need one yourself so allow for that.

You should include holiday at £60 per month and also try a contingency of £50 per month. I always put these in and have not had any trouble yet. Everybody needs that little set aside for when a washing machine breaks or the car needs urgent repairs.

I've never heard of anyone being allowed a contingency in BR as this should come out of any surplus income.
I agree with Jan, the figures that you put down should be what you actually spend and shouldn't be inflated just to avoid an IPA.
Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.

If you inflate the figures, the OR will just knock them down
Just put exactly what you spend and then if you have to send in reciepts, etc to prove it, you will be ok
contingency is not allowed in bankruptcy, neither are:
xmas birthdays etc

Hi my hubby has an appointment at 9:15 on 14th Jan TOMMORRRROW to file for BR we have filled all the forms spent hours getting all the paper work in order not sure what will happen tomorrow can anyone tell me pleaasssse !!! |

Please do not fret.
It is a process that is over within minutes generally. Sometimes, a petitioner will not even see the judge - it will be the cleark who passes the petition to the jidge and he/she makes the order and all that happens then is the BO is passed back and the next stage is the OR interview - again, generally nothing to worry about and the OR examiner will be very understanding in most cases. Be honest with them when being interviewed - that is all it needs! Good luck, Richard

Only just seen your last posting yesterday night.
By now, the process will be behind you and the next step is the OR interview. Again, it is going to be (in all probability) much less daunting than you are thinking.
The OR is an officer of the court and yes, his duty is to the creditors, BUT, if you are honest and open with the examiner at interview, it will be fine.
I look forward to the posting later to say the court was fine too!

although all courts are roughly the same, they do have regional variations, it might help posting the court and someone may have attended the same court and give you the run down
