The creditor would serve a statutory demand at the address they believe you to live at. You have 18 days from service to defend the situation - provide good reason why a petition should not be made. If you do not oppose it then after 21 days the creditor could apply to the court for a bankruptcy hearing.
The court will notify you of the hearing date and if you did not attend then the judge could well make the order and you would be bankrupt without signing anything

If you feel that a creditor could be persuing this route then best to talk to one of the experts so that they can review your situation.

Posted - 17 April 2008 : 18:35:19 Unless you dispute the debt, you will have no choice if a creditor decides to petition for your bankruptcy - but you will need to have the papers served on you personally unless there are very specific circumstances which would prevent this - so you would get prior warning.

Is this what you meant by your question or were you referring to someone declaring Bankruptcy on your behalf?

One of your creditors could petition for your Bankruptcy without you signing any papers, they would first have to issue you with a statutory demand and follow this with a Bankruptcy petition.
Is this what you meant by your question or were you referring to someone declaring Bankruptcy on your behalf?
