Posted - 11 June 2008 : 17:12:44 My BR date is on the 5th Aug, as I was originally going for an IVA I have already missed 2 months of payments I am writing to my creditors to advise them of my intentions and giving the court date. Between now and then can they instruct bailiffs??

Thank you for that it puts my mind at rest I am sending my creditors letters advising of BR tomorrow.

If you have only missed 2 payments then it is impossible for them to get bailiffs in within the remaining time ( unless you have council tax arrears )
Timescale for bailiffs
1. You need to receive the blue & white County Claim Form. If thus arrived tomorrow you can send acknowledgement of receipt and ask for 28 days to respond / defend ( all done online)
2. That would give you until 9th July. at this stage it would go before the judge in Northampton and in the absence of a defence they would enter a judgement against you.
3. It is at least 30 dats before any bailiff activity happens taking you past your court date.

I am certain that your creditors won't do anything once they know you are petitioning for your own BR - you're saving them money after all.
