My husband and I both have student loans that are currently deferred - I know that they cannot be included in the bankruptcy, but do we still need to detail them somewhere on our forms?

Hi T76,

Unfortunately, Melanie is indeed correct. The reason this loophole was closed is that too many people were graduating from university, immediately going BR and then getting on with their life. As student loans are (ultimately) underwritten by the government, it's not too hard to see why that loophole was quickly closed!

Your student loans remain outside the bankruptcy, but you must disclose them on your statement of affairs.

Sorry, another quick question - my student loans were taken out in 1997, 98, 99 and 2000 - are any of these allowed to be included in my bankruptcy?
