Where ours was an old claim which we were billed for and would have been allowed to pay over 2 years as they could NOT include in the new claim SHOULD be written off.
Is that right as paul has confused it for me thats why i went looking.

As I understand it, any historic overpayment of tax credits etc from HMRC should be treated like any other unsecured debt in BR.

What about an old bill that has been billed to you as an IR bill/debt which is not being paid via your current tax credits claim.
This is how mine is now. I though that bills from the IR that were not being paid per your claim but on a seperate bill from them would be included as i am not having mine deducted now as it went straight to payment per month by me not my current monies.

I have checked with he OR and tax credits dept and they advise that an overpayment does not get included in Br so will need to be repaid.
However you need to include this in the I&E to ensure you are not getting penalised twice.

Posted - 10 October 2008 : 18:05:49 Ah in that case i dont think it can.
Ours had been billed as we seperated then i put the claim to single then we got back together and they could not just add OH back on so closed the original claim and started a new one. Then we were billed for the overpayment. I asked if they could pay it out of our current claim and they said no. So im not really sure i think it may be that you have to continue but i may be wrong. Hope you find out for def. LOL

When you say paying monthly is it being taken from your current claim or were you billed.
The reason i ask is that we were billed and agreed a repayment and now that has gone into our BR.
