Posted - 12 August 2008 : 09:15:31 My IVA failed on the 31st July and I go bankrupt this Friday (15th). Last night I had my first call from one of my creditors Capital One saying that I needed to make a full and final payment there and then. I explained about the bankruptcy and they said could I call them once it was done, I did say that the OR will be in contact with them... I am assuming that is correct?
It's been a year without any creditors calling and I certainly haven't missed it! I am expecting them all to start calling now!
I moved on the 4th July and as far as I am aware none of my creditors know my new address. Capital One said that a letter had been sent to my old address and I wasn't in a hurry to give them my new one.
What would happen? A member of my family still lives at the old address, would the bailiffs come round or is it far too soon for that?

Posted - 12 August 2008 : 09:27:13 I should imagine its too soon for that, they need a court order for bailiffs which i think takes about 3 weeks. They are going to phone you and try to get some payment first, screen your calls to prevent unnecessary upset, i didn't answer most of them as the one company who i mentioned BR to threatened to start action via bailiffs and putting a charge on the house. But as you are petitioning on friday, i would imagine you are going to beat them to it, like i did.

Yes it's too soon for bailiffs.
The OR will contact them within a month of the bankruptcy to report on your assets and liabilities etc.
