Hi vacs
ians / CG is correct here.
A joint account is joint & several liability so if you are BR all of the overdraft becomes your OH liability.

Hi vacs,

I think sarah is right here and that if only you go BR, your other half would be liable for all the overdraft debt, regardless of what it was spent on. It would only be included in the BR if both of you were to go BR.

shouldnt the joint account be split 50/50 for the B/R
vacs Posted - 12 August 2008 : 18:39:45
Even if they where used to pay my creditors

i think the debt on your joint account is passed to your other half, and they are liable to pay it.

if im correct and you have disclosed it to your OR then it should be included if you have both gone bankrupt
