hi,
I have been left in debt by my ex-partner. I am on a low income and have no assets. Bankruptcy is my only option to make a fresh start.

Should I inform my creditors that I will be filing a bankruptcy petition?

Also, is it true that if I do not have proof of having sought advice from CAB, CCCS etc, the court will reject my petition?

Thanks for your help

Hi
I would not inform the creditors as this could trigger endless calls and even visits to your home.

No you do not need to seek advice from CAB or CCCS per say.
But the judge would normally ask if you have taken advice as they need to be sure that you are aware such advice exists.
He would also ask if you are fully aware of the repercussions of bankruptcy.
A simple answer of "yes" to both questions and you're ok.

I would recommend you do take some advice though, even becoming familiar with this forum will help.
