Posted - 28 December 2008 : 23:35:21 i just need to check were i stand regarding debts over six years old,i have debts in total 12yr old that i was made bankrupt for,i know certain debts go after a set period of time is this the case for council tax as they would of obtained a liability order,does this change the six rule even if no contact from any baliffs. |

the debts will be included in the bankruptcy.
however any assets you had at the time, or any interest the trustee has in your property, will be used to pay off some or all of the debts.
the trustee can sell the house to clear the debts in br plus their fees etc. i know of a lady who was made br by the council for council tax - £2000 - and has now had her house sold even though there was £250000 of equity in it.
your case sounds a little to complicated to understand in sections so i would recommend you call either the helpline or an assisted bankruptcy specialist to have a telephone discussion about your options and position.

Posted - 30 December 2008 : 03:38:11 thanks for the reply how can the outstanding council tax be overturned,if the debts are queshed due to bankruptcy do i still owe it as the trustee is trying to sell my house for this debt,any advise gladly needed.thanks |

if you were made bankrupt for certain debts then these would be written off in the bankruptcy. ( only caveat is that if you had a property and the trustee declared an interest then there may be some claim on your current position)
Council tax is generally written off - for previous tax years - in bankruptcy
