Posted - 02 July 2010 : 16:45:07 The house is solely in the maiden name of my wife as is the main mortgage, however we took a second mortgage in joint names. If I am made bancrupt can they seize the house?

Posted - 05 July 2010 : 13:21:37 Only I will be made bankrupt not my wife. The second charge is joint and several. There is equity in the house. We have lived together all the time and I have been contributing to the household. When the house was bought a letter was drafted signed and lodged with the conveyancing solicitor stating that I had no claim on the property. We got married 2 years later and now have 2 sons. The second charge was taken to pay off other debts.

Who is going Bankrupt? Is it you or both?
What was the second charge for - is it joint and several (I assume that it is - it must be)
Is there any equity in the property?
