Posted - 22 February 2011 : 15:14:59 Hi everyone,just had a bit of good news today my insolvancy clerk has rang to advise us the he is now applying for ED and we should be discharged in may/june at the latest!!!!Can anyone advise me what will be happening now? he advised me that he has just sent the new I&E forms ,but what else will be happening Thanks |

From what I have read I don't think you will be getting anything else, apart from the new I&E form, from the OR. As you haven't had an IPA you will be assessed under the new rules & I'm sure you will be fine. Expenditure has risen so much recently hasn't it?
You will have to keep an eye on the online Insolvency Register to see when you ED goes through. I beleive the OR doesn't inform you of when it actually happens. Don't forget to print numerous copies of your discharge notice as you will be charged for them at a later date.
Again Cograt's & let us know when the deed is done.

Posted - 22 February 2011 : 16:17:41 This is the grey area...in the insolvency guide it states.. "where the initial assessment is made on or after 1 December 2010 (regardless of the date of the bankruptcy order) and the bankrupt has surplus income of £20 or more, the full amount of this surplus income should be sought by way of monthly payments under an IPA (or an IPO if an IPA cannot be agreed)" what is the initial assesment? Bigal...any ideas? |

Do you already have an IPA? If so you will be assessed under the old rules and won't be able to include anything for emergencies.
