hello,
i went bankrupt in( jan 2010) but i am being chased for a small amount £71.00 from a debt collection agency. At the moment i am not working and the debt is for an on-line work website which offered a 3 mth trial but would not let me cancel and said i could not stop it and would have to pay for 12 mths. My wife paid for all the3 monthly invoices but stopped because her finances are limited now.Is their any thing i can do please.And will the debt agency come to my house for the debt which i do not think that i owe because i never signed anything. |

Hi,
reading into your post, and from the time frame it would appear that you started this around the time of your bankruptcy, so if the £71 is after the bankruptcy, then it's highly unlikely that it could be claimed in bankruptcy.
But there again, if they go for a CCJ and you can show through documentary evidence, times dates of phone calls etc that you tried to cancel the trial before the 3 months was up, then you could let them go to court and let the court decide whether they have a valid claim, but equally it may be wise to seek advice from the CAB.

When was the debt incurred? Was it before you were made BR or after?

Last IPA payment made on 28th June 2010 and I'm now looking forward to getting married in September 2012 - I'm proof that you can go BR and come out the other side. |
