Posted - 28 August 2012 : 16:00:06 My creditor to who I owe £10,000.00 want to make me bankrupt. I am opposing the bankruptancy on account of unreasonable refusal. Because I have offered to pay up to £450 a month, have the debt secured against my home and pay an intial deposit of £1000. I have submitted a notice of intention to oppose bankruptancy, but the court office was closed when I went in of Friday, so the court would have received that form today. The hearing is this Friday, so that's not the 7 days notice that they wanted. I have also submitted it to the opposition solicitors. What happens at the bankruptancy hearing? Do I need a solicitor? Could I take a family member to help me present my case? Are the judges friendly or what? I'm really worried about this. Would the judge be annoyed that I didn't sent the notice of intention to oppose at the right time? |

The judge has ordered that they creditors accept my proposal of paying a initial sum of £1000 and then £450 per month afterwards. Better than being bankrupt I guess. Thanks again for all the support guys! |

the judge will understand and try to be helpful about the 7 days.
The judge will be less sympathetic if you are not properly prepared for the court case.
the other side may well accept a negotiation on the steps of the court but it depends if the action is vindictive or business related.
you are normally allowed a "mackenzie friend" but as to the level of involvement will be direted by the court / judge.
i would suggest running your "defence / proposal" by someone who works in the insolvency field not just a solicitor who can spell Insolvernsee !!
