i already had an iva,which i payed every month,but i worked in the motor industry!!i say worked because when i go back on the twelth of jan theres a good chance 99% thats it(first in last out)i was told to miss two payments which i did but i heard nothing.i rang them and was told in my agreement there was a clause that they could declare me bankrupt,how long do i wait????????????they know all about the situation????

Hi

unless you have paid in a considerable amount into the IVA it is unlikely that DFD will pursue you for Br.

I have 2 clients who have been unable to pay their IVA for 12 months ( loss of jobs & relationship breakup) and they still haven't had any notice / letter etc from DFD

Hi sgr
I was in an IVA, I will be made Bankrupt on Tuesday of next week,
I belive that it is 3 months missed payments, for the IVA to fail.
But it can take up to another 3 month before you are made BR.
depending when they can gat a court Date,
There have been no fee's paid by myself, as I am being made BR by the IP.
Hope this will help

Sorry i should have said IP Insolvency Practitioner.

So your with debtfree direct. It may be worth when they are open giving them a call and asking them what the state of play is.

I would if you can do the BR (bankruptcy) yourself.

Hi sgr

If you dont mind me asking, who was your IP for your IVA.

Also it can take a while for them to do it, if you want to to do it yourself then you will need a cert of failure to take to the court when you go yourself.

The benefit of doing it yourself is you maintain your dignity and can stay incontrol.
