Hi again, picked up papers from court 2day.OMG looks like fun!! Question?? i have an active car insurance claim which may well payout within the not so distant future,ie: next 6 months Will i be able to keep any of the money?? thanks Tracy.

Hi Tracy

Yes it would be ok to stop the payments i would have thought as you need to save the fees the only thing is the creditors will start to hound you once they realise so you need to try and get your bankruptcy done as soon as you can.

The overpayments as far as i am aware can be included in your bankruptcy too but in 5-6 months they may have treid other ways to get there money, so if i were you i would see if you can get the fee together sooner rather than later.

If your on a low income you may be able to get a bit of help with the fees too.

Hi, some more of those lovely questions,
we were on dmp, it is ok to stop payin this to save the money for BR?? which will still take about 5-6 months, wot will happen during these months??
Also, we have just had a benefit review from last nov till now and hosing ben have said we have been overpaid for both C tax and housin ben.to the tune of 1200 for rent and 800 for tax, can we include this on BR?? thanks WFTC!!
For which thry have sent two invoices for payment by return!! LMAO
cant give you wot we aint got.

well how glad am i????? i have recieved so many nswers to so many questions on this site, and i want to thank u all. it makes such a huge diff, i feel anything can b asked and magically the answer appears!!LOL i hope we can keep the ins money, it wud be so helpful right now.Need it for court fees.well we have a long way to go but im sure with all the support avail here we WILL get thru it.Have since found out that we shud not have been put forward for IVA, we dont own the house and we have no assets!! and ccant afford the £200 min payment each month.Why do these people tell you lies??? they are supposed to b helpin u out of a bad situation, not makin it worse and in the process adding to our debt.we owe more now than when we started bac in may!!But i fear no evil as i have found u all,many thanks again and im sure you'll be hearing from me.

I got to agree with Jo - the forms are soooo much easier online. And you can work through and save them as you fill in each section.

Good luck with them !!

Onwards and Upwards is the way im going :-0)

Thanks for the reply Jo, No its for personal injury compensation,they paid out for the car nearly 2 years ago now but still not recieved monies for pers injury.the solicitor reckons poss about £4-5k.i have had to fight hard for this money and im just alittle sore about finally gettin something and losing it!!!!

Depending on the amount the OR may allow you to keep enough to buy another car if that is what they are allowing you to do max about £2k and they may well take the rest.

Is the claim for a written of vehicle?

Oh and you can do the forms online its a little easier i think, you can find them at:
