Allthough I have informed my IVA company in advance that I would be retiring at 60, (ill health ) and filing for BR. And sent three letters since, in reply to their demands. Also I have asked for all comunication in writing. My letters have been ignored, they have said I am ignoring their letters. Not true. and keep phoning me. I am about to send them another letter. My letters have been addressed to the correct people and have my ref number on each letter. not sure what else I can do at the moment. I believe I need to ask them for a Certificate of failure, is this correct. Carol

Thank you Julian, You are being a great help to me, and giving me the confidence to procede. I do find it a worrying and a bit scary experience. I have been honest and have informed the IVA company of my situation and intentions in advance. I am on my own and do not have any people around me for support. So thank you again

Hi Carol,

It does seem to take a long time for some IVA companies to initiate failure proceedings. Keep on them! I would sugegst you'll be waiting some time for a Certificate of Failure, but a letter from them confirming the IVA has now failed will suffice. Without this, the court will turn you away.
