Posted - 05 March 2009 : 10:20:38 I was made bankrupt on the 11th November 2008. However, one of my larger creditors has put a charging order against my property after this date...December 2008. They are still sending me letters for a payment plan and now they are now sending me letters threatening me that they will have to sell the property to recoup their money.
I did inform the liquidators at the time in December but i feel they have not done anything about it.
1. Can the creditor put a charging order after the bankruptcy date?
2. Can i get the charging order removed?
3. How?

Any charge put on the property after the date of the bankruptcy order is void and can be removed by the Trustee/OR. If you are going to keep your property and buy back the beneficial interest, once this is done you can send a copy of your bankruptcy order to the Land Registry asking them to remove the charge as void and also send a copy to the creditor informing them of what you have done.
