Posted - 16 July 2009 : 09:38:30 I have a company which is not doing well at all there are 2 shareholders and my wife is also a director the 2 share holders have 12 shares each my wife has 27 i have 49 because the company is not doing well i need to close it down but one of the shareholders is a ex bank manager who is now blackmailing me if i shut the company down he said he would bankcrupt me the company is £16.000.00 in defersit the total bept could be around £45-50.000.00 is it better for me to go bankcrupt or wait for him to do it to me There is probably no clatrel in my house my wife workes she has her owen car in her name and is paid for by her other than that we have no assets apart from a villa in florida the morgage is in my name my wifes name and my wifes parents names there is also no clatrel in the villa because of the credit crunch the morgage is done in florida and all taxes are paid in florida if i got a new job could he still bankcrupt me my wife and i have now split up even though we are trying to live in the same house none of us can afford to leave i am desperate to save my marage and keep my family together i just dont know what to do i cant seem to find any help or advice anywere

i assume it is a limited company, and if so your personal liability will only come into play if you have personal guarantees.
I would really recommend that you have an offline conversation with either the helpline or one of the forum experts.
You need to be in control of and understand all the options and potential liabilities
Posted - 16 July 2009 : 09:55:24 It would cost him to make you bankrupt so I think it is likely to just be a threat. Could he help in any way to keep the company going?
Is it just business debt you have or personal debt as well?
