Posted - 04 August 2009 : 16:00:53 Hi again all,
Some of you will know I keep harping on about the fact a BRU was mentioned for us back in Sept 08 when we had our OR interviews and that we haven't heard anything about it yet.
Just to update that it's now 5 weeks till AD and we've still heard nothing, so although our fingers are still firmly crossed, we're hoping and praying nothing's going to come of it.
Please keep your fingers crossed for us too!

Posted - 04 August 2009 : 17:02:58 If you haven't even had a second interview they cannot go to court and claim misconduct they haven't even put to you , as you have not had the opportunity to explain your reasons etc.
I would put money on you getting an automatic dischage on your 12 month anniversary.

Posted - 04 August 2009 : 16:57:21 Thanks Suzanne,
I've read the following ont he IS site:
'If the official receiver takes longer than 9 months from the date of the bankruptcy order to finalise his report, he will apply to the court for a BRO and will write to tell you he has done so. You will receive this letter at least 6 weeks before the court hearing date. The letter will include a copy of the application to court, the report, and supporting evidence giving details of the alleged misconduct. This letter will inform you of the hearing date and of the period that the official receiver suggests the BRO should last. You will be asked to acknowledge receiving the documents on a form that you should return to the court within 14 days.'
Is this unlikely to happen? I get the impression this may be quite rare, am I right? Especially as we haven't had a 2nd interview or anything, like you mentioned.
Thanks so much for your input-it's so helpful.

Posted - 04 August 2009 : 16:52:00 Hi BankruptC
It's too late for them to do a BRU now. They have to have got it signed off within 9 months and that has gone passed by now, especially if they haven't interviewed you again.

PS. Suzanne, if you're reading, do you have any further info on the likelihood of getting a BRU so late at all? Thanks! |

Posted - 04 August 2009 : 16:42:24 Hi there,
Have read a number of your postings and was only recently BR on the 19th May - 8 and a half months to go...
I wish you well over the coming weeks and, of course, after your BR is discharged.
I am looking at the postings on this site every fday now - it is such a useful place to seek advice and share experiences
best regards, Richard |
