Hello, Moved into a property in March 2007, and it was not listed so did not have to pay Council Tax, then in Sept 2007 they said that they had to come and value it and band it,(which tooko them TWO months to do - even though I was constantly contacting them to do so) then in Nov 2007 I went bankrupt, at the end of Nov 2007 i received a council tax bill for March 2007 - March 2008, I said that I didnt have to pay as I was bankrupt and it had been included in my bankruptcy.
It has now been going on and on for 7 months now, and I now have a court order saying that I have to pay - although my Financial Advisor and my Official Receiver are telling me not to as it is Illegal to pay my creditors now as i am bankrupt. I really do not want to go to court, and shouldnt have to pay it - just because they sent the bill after I went bankrupt! Please advise what I should do, I am really worried about this.

In certain circumstances a Liability Order can overreach bankruptcy proceedings. Zoe is the expert on council tax arrears so I will try and draw your post to her attention.

Hi My advice is pay it some how I was made bankrupt for council tax and believe me they dont think twice about doing it even if you offer them some kind of repayment plan. They will make you bankrupt in a flash, |

Hi 369 welcome to the forum,
In this you should send the council a copy of your Bankruptcy Order and direct them to your OR dealing with the case.
I would also copy this into the court to show that this amount should be included in the Bankruptcy.

Thank you for getting back to me.
I have already sent a copy of my bankruptcy order to the council. The council stated in a letter that when I was made bankrupt I owed NO council tax, however, when they sent me the bill on the 27th Nov it was for March 07-08, so I did owe them the money - its just that they had sent me the bill 3 weeks later!!! Not my fault that they are slow off the mark at sending bills out! My OR and the Council Rep have been talking about it, and they still disagree on the outcome - so what am I supposed to do - if they cannot even decide?!
Fact is I cannot pay £700 to them in the next two weeks - and am being told by my Advisor and OR that it is ILLEGAL for me to pay it as I am bankrupt - who do I believe?!!!
I went bankrupt for other reasons - and this has only happened after I went bankrupt, but council tax was included on my list of creditors.

Hi 369,
If they were on your list of creditors and the debt was prior to the Bankruptcy then it is illegal for you to pay them and you should listen to the OR.
You need to inform the court which granted the liability order and send them a copy of your Bankruptcy Certificate.
The council seems to think they are above the law and need to learn they are not.
