My question is, if all my debts are based on an address (and where I am on the Electoral Roll) in Scotland, do I have to apply for bankruptcy (or the Scottish equivalent) in Scotland or can I apply in England (where I currently reside)?

Hi Victor

the court will ask for your centre of main interest (COMI) this is the place that you have lived had bills paid from for the last 6 months.

Trust deeds and sequestration (IVA & Bankruptcy) are the scottish equivallant. i would refer you direct to Paul at Reviva as i know he has recently helped some people over the borders.

to save you filling the wrong forms or going to the wrong court speak to any of the experts

regards Richard
