I am going to declare myself bankrupt soon , I am moving out of my rented accomadation in 2 weeks and back in with parents, my question is I have a months deposit with my landlord to get back when I leave this property if I declare myself bankrupt before I receive the deposit back do I have to hand it to the OR or should I declare myself bankrupt after I receive my deposit back. Also if my debts are all registered to my rented property if I declare myself bankrupt after I move in with my parents will they be affected in anyway.

Hi gedc1,

Why not wait until you get the deposit back and use it to pay the BR fees which could be either £510 or £600 depending on when you declare BR as they increase from the 6th April. If you go BR before you get the deposit back the OR will take it.

Your debts and credit file will be changed to show that you have moved address but this will not affect your parents in any way so don't worry.

Are you planning to inform your parents about the BR?

Hi gedc1

In addition to the response from David F, when you file your petition for bankruptcy you have to disclose your current address, and any address for the previous 6 months, so when the bankruptcy is advertised it will include both addresses if you move back to your parents before making yourself bankrupt

But your parents credit rating should not be affected. If either of your parents has the same name as you there is a theoretical possibility, but it is relatively straightforward to rectify
