There'sno need to be rude Digman. As has often been pointed out, going bankrupt affects the rest of your life potentially so in that respect Daniel is right in his commnets.
There is nothing to stop him going bankrupt at any time that he is insolvent BUT if he does it now & is ex can somehow keep the house going for a wile, he could still have the shhortfall problem later.
I would say that digman was quite correct in his response to Daniel. He was asking for advice to his friend's predicament and rather than providing advice Daniel expressed his opinion without any advice.
We need to remember that this board is for advice and not personal opinions. People who post here do so as they need assistance and not someone who is going to judge them.
digman - Your friend can declare BR provided he is insolvent i.e. he is unable to pay his creditors after paying for rent, food, utility bills, etc.
BR isn't something to be taken lightly and he should be aware that he could more than likely lose his car. A car up to £2k is only normally allowed once you declare BR and only then if the OR believes that it is needed for work reasons.
Thank You debtinfo that was what I was getting at I cannot see how he can state "I an unable to pay my debts" on the petition at this time perhaps I should have said that instead, appologies to anyone offended.
I disagree, if someone posts on this forum for advice they should have the courtesy not to be rude to those who bother to reply, even if they may disagree with that advice.
