I have a client who has resided in Spain for the past 2 years, he has debts in the uk that were built up before he left. Can he declare himself bankrupt from Spain? He has no assets in Spain or uk and minimal income in Spain.

Within europe a person must declare bankruptcy within their centre of main interest, which is usually where you have resided or traded for the last 6 months. Therefore at this present time they would have to declare bankruptcy in spain. If he wanted to declare bankruptcy in the uk he would have to return to live here for the forseable future.

sue if you and your client(s) need further help Paul @ reviva (expert to teh left)has a spanish office and i believe helps a number of people deal with bankruptcy and other finances whilst they are abroad.
