Hi,
This is my first time on here, although I have lurking for a while

My husband was made redundant in Oct 09 and since then we have been dealing with our creditors ourselves, hoping that we would be able to come to an agreement when he got another job. To cut a long story short my hubby is now back in work ( although on less money) and we have been advised by a family friend who is also an IP that the best route for us would be for both of us to file for bankruptcy....

We are trying to get the money together to do this as soon as possible but my question is what do we do about the creditors in the meantime? Our IP has told us to ignore them but that is easier said than done....and I am concerned about someone just turning up on our doorstep...

Should I write to them and say we are going to go bankrupt?

Does anyone have any advice? I am so pleased I have found this forum. I sway between being relieved it's getting dealt with, to complete terror and embarrassment that we are in this position...

Hello Sunshine

Its good to have the friend of an IP who can help you in this matter. Creditors simply most of the time want to know whats happening, when people ignore their calls they have to call more to find out what is going on. Its always better to tell them about the bankruptcy they may not all welcome the news but at least they know what you are doing about your debts. They will of course want to know when you are doing this so some sort of time frame will help. I think its highly unlikley they will turn up on your doorstep depite saying they will, however remember all further action against you is fruitless as the bankruptcy order will dissolve all that action, good luck

Hi sunshine

welcome to the forum and what a way to make an impact 3 postings in one hit !

Once you have had your situation reviewed and BR is the only option then you should stop paying your creditors.

If Hubby is at work and your debts are not totally un manageable you still have options (speak to one of teh experts to the left)

DO NOT tell your creditors of your plans until the last minute or else they may get to court before you and you have then lost control of the situation.

Creditors normally take about 3 months of non payment to start chasing you and meaning it ... yes their letters are intimidating from day 1 but you have time...... I lasted about 14 months before it got to absolute crunch but i would not encourage anyone to follow my lead.

at this moment in time you should be planning your BR, house , cars ,assets etc is it necessary for you both to go BR at same time ?

you will have hundreds of what if questions the best advice i can offer is continue to post but also speak to one of the experts to the left.

I used paul and his team at reviva and they were ab fab, put your mind at rest and see if you can negotiate with paul for one of his team to come round and have a coffee, they will be able to review your circumstances and confirm that BR is appropriate, then they will be able to answer all of your questions connected with BR

Thanks guys,

You're right I do have loads of questions....I suppose I just want to make sure we're doing everything the right way round.

Our IP has suggested it may be beneficial for hubby to go BR first and then me...

I have started to fill the forms in, our IP said to fill in what we can and he'l help us with the rest. I wish we'd plucked up courage to speak to him ages ago...but we thought we'd struggle through ourselves....how wrong we were!
