My daughter just got a new house so i wanted to give her a gift, the only way i could do this was to order from my catalogue, i got her a laptop which was £699 and have been paying it for a couple of weeks, but i have decided to go bankrupt due to a large debt belonging to my ex husband (the debt landed on me) my question is will my catalogues be cleared in the bankruptcy and is there any risk of being done for fraud getting items so soon before i go bankrupt?

Hi Mary.

If you can show your reasoning behind deciding bankruptcy, and show that these two actions are completely segregated subsets, then you have no risk at all.

I.e 1) That you decided to buy your daughter the laptop because you thought you could afford it (you were solvent at that time)
2) That you received some form of communication from a creditor belonging to your ex husband that you were unaware of that then made you realise you were insolvent.

This would show that you were not trying to manipulate the system but ironically timing was just against you.

Worst comes to worst, if you feel bad about the situation, you could offer to pay the Official receiver via a 3rd party the £699 oustanding and then owe the 3rd party the money. This would completely eradicate any bad feelings/trust problems.

Best of luck

Regards
