A number of buy-to-let properties formed part of my bankruptcy. The building society has handed them to an LPA. Am I still responsible for the council tax, as I am being threatened with court action if I do not pay it.

Hi

There is something called "Q" tax which may be applied to your BTLs - are they void?

Speak to your Council Tax team and/or the OR or Trustee appointed.

Hi David

I also had a number of BTL properties in my bankruptcy.

I have had to speak to each of the local councils stating that i am BR,they initially entered the void properties as Q tax. it was well worth sitting down with large coffee writing off a whole morning and making lots of phone calls at one time

once they had it from the mortgage provider that i was no longer responsible for the property they eased up on me.

If you have any properties with Northern Rock be ready for a battle, as it appears they want to property bank the property without having liability so will not talk to the local council, local council dont care they just want the money so will chase you, some of the council tax debt may be incurred after Bankruptcy so the OR may / will nit want to include.

keep a diary / computer entry with all of your conversations and contact names

officially there should be no council tax due in the year that you are declared BR.
The properties should be band Q and exempt as being part of a Bankrupts estate.
However once you are out of BR if the mortgage provider has not accepted the house back or accepted responsibility for it the next years council tax is a debt incurred after BR and you are liable as being the legal owner until someone else is.
northern Rock are very good at doing this!!!!!!

Thanks for all your replies. I have five BTL mortgages with Northern Rock, so I could be in for a rough ride.
