Hi There,
I have a question, I am a EU National, and i have 4 kids, me and my husband have bought house in uk a few years ago, but we couldnt meet the repayments, I aslo have 3 loans everything around 16 k debts, What is the best option for me to do now?

are you living in the UK now and if so how long have you been living here

I have been living in UK for 5 years, in june 2008 I left and now I am living in Belgium. I am thinking if we would come back to UK what shall we do? we put so much money in this house

Then at the moment you cannot petition for bankruptcy in the UK as your centre of main interest will be in belgium. I f you mived back to the UK permenantly then you could petition here therwise you would need to look at what the inslvency options are in Belgium

Hi agakumar / agnes

from what you have typed I would suggest that you do not qualify for BR in the UK, it all comes back to the centre of your main interest.

The insolvency service are starting to get quite strict on "bankruptcy tourists". I take it that the three loans were taken out whilst in the UK and you do not have any other European debts, if this is case it would strengthen your case.

I would suggest that you speak to one of the experts, I recomend Paul and his team at Reviva.

I would agree

you are currently outside "England & Wales" and as such your main interest ( job, income, home, etc ) is in another EU country and therefore you would need to petition abroad .

If however you were to relocate back to your home in the UK ( not sure from your posts if it has tenants in etc ) but provided that youwere here for the greater part of 6 months it would I am sure be accepted by the court.

After all the debts , house , mortgage etc are all here.

we left our friend there, he was in charge of everything, we had tenants there, he should put money in the bank to pay mortgage, but he didn,t
